General Terms and Conditions of Sale
1. Scope
These General Terms and Conditions of Sale govern all sales made through www.dagueart.com between Guédat Tec. development, the operator of the Dagueart brand, and any person making a purchase through the website.
They apply to all products offered for sale, including knives and laser-engraving personalisation options, unless specific provisions are expressly stated on the website or otherwise agreed in writing.
The products offered on www.dagueart.com are intended exclusively for persons who have the legal capacity to enter into a contract under the law applicable to them.
By confirming an order, the customer acknowledges having read and unconditionally accepted these General Terms and Conditions of Sale.
The applicable Terms and Conditions are those in force on the date the order is confirmed. Dagueart reserves the right to amend them at any time. Any such amendments will not apply to orders that have already been confirmed.
These Terms and Conditions are available in several languages. In the event of any discrepancy in the interpretation of the different versions, the French version shall prevail.
Should any provision of these Terms and Conditions be declared invalid or unenforceable, the remaining provisions shall remain fully valid and applicable.
2. Products
Dagueart offers knives for sale, as well as any accessories and personalisation options available on www.dagueart.com.
Every effort is made to describe and present the products accurately. The essential characteristics of each item are provided on its dedicated product page.
Photographs, videos, 3D renderings and previews displayed by the configurator are intended to represent the products as accurately as possible. However, they are provided for illustrative purposes only and do not constitute a contractual commitment.
Minor differences may exist between the digital preview and the delivered product, particularly due to the materials, finishes, laser-engraving process, lighting conditions or display settings of the screen used by the customer.
Products are offered for sale subject to availability. If a product becomes unavailable after an order has been confirmed, Dagueart will inform the customer as soon as possible and will, depending on the circumstances, provide a full refund of all amounts paid or propose an alternative solution with the customer’s agreement.
As part of the continuous improvement of its products, Dagueart reserves the right to make minor changes to its products, provided that such changes do not affect their quality, functionality or intended purpose.
3. Prices and payment
Prices displayed on www.dagueart.com are stated in Swiss francs (CHF). They include applicable taxes unless otherwise indicated.
Delivery charges are shown separately before the order is finally confirmed.
Laser-engraving personalisation is offered as an optional service. Its cost is clearly indicated during product configuration and added to the total order price before payment.
Dagueart may occasionally offer promotional codes, discounts or special offers. Such benefits are subject to their own specific conditions and may not be combined unless expressly stated otherwise.
Full payment of the order is due when the order is confirmed. The available payment methods are those displayed on the website’s payment page.
An order is deemed confirmed only once the payment has been approved by the payment service provider.
The products remain the property of Dagueart until their full purchase price has been paid.
4. Personalisation
Certain products may be personalised by laser engraving using the configurator available on www.dagueart.com.
The configurator allows customers to add text, an image or a logo to the surfaces intended for this purpose. The displayed preview is provided for illustrative purposes and is intended to represent the final result as accurately as possible.
Minor differences may exist between the digital preview and the completed engraving, particularly due to the materials, finishes, laser-engraving process and manufacturing tolerances.
Before confirming the order, the customer is responsible for carefully checking every aspect of the personalisation, including:
- the text and its spelling;
- the font;
- the position of the engraving;
- its orientation;
- its dimensions;
- any uploaded images or logos.
Confirmation of the order constitutes final acceptance of the personalisation as displayed in the configurator.
The customer warrants that they hold all rights required to use any text, images, logos or other content submitted to Dagueart. The customer remains solely responsible for their use and for any infringement of third-party rights.
Dagueart reserves the right to refuse any personalisation that is manifestly unlawful, contrary to public policy, infringes third-party rights or may expose Dagueart to liability. In such cases, the order may be cancelled and refunded, less any costs already incurred where applicable.
Personalised products may not be returned or exchanged, except in the event of a defect covered by the statutory warranty or an error attributable to Dagueart.
5. Orders
Orders are placed directly through www.dagueart.com by following the different steps of the purchasing process.
The customer undertakes to provide accurate, complete and up-to-date information, particularly regarding their identity, delivery address, billing address and email address.
The customer is responsible for any error in the information provided that may result in a delay, an inability to deliver the order or additional costs.
An order is deemed definitively confirmed once payment has been approved by the payment service provider and a confirmation email has been sent to the customer.
An invoice is automatically issued electronically to the email address provided when the order was placed.
Any request to amend or cancel an order must be submitted to Dagueart as soon as possible. If the order has not yet been prepared or dispatched, Dagueart will make reasonable efforts to accommodate the request, without being under any obligation to do so.
6. Delivery
Dagueart ships its products within Switzerland and internationally, subject to any restrictions applicable in the destination country.
Orders are shipped to the delivery address provided by the customer when placing the order. The customer is responsible for the accuracy of the information supplied. Any costs arising from an incorrect or incomplete address may be charged to the customer.
Delivery times displayed on the website are estimates only. They may vary depending in particular on the destination, customs-clearance procedures, the carrier or circumstances beyond Dagueart’s control.
A tracking number will be provided to the customer once the order has been dispatched, where this service is offered by the carrier.
For deliveries outside Switzerland, any customs duties, import taxes, customs-clearance fees or other local charges are the sole responsibility of the customer.
Before placing an order, the customer is also responsible for checking whether the products may lawfully be imported, possessed and used in the destination country. Dagueart shall not be held liable for any refusal of importation, seizure, detention by customs authorities or any other measure arising from the laws of the country concerned.
The risks associated with transportation pass to the customer when the order is handed over to the carrier, in accordance with the applicable provisions of Swiss law.
7. Returns and warranty
Returns
Non-personalised products may be returned within 11 days of receipt, provided that Dagueart’s prior approval has been obtained.
Products must be returned complete, in their original condition and in their original packaging.
Return shipping costs are borne by the customer.
The original delivery charges are not refunded, except in the event of an error attributable to Dagueart or where reimbursement is required by law.
Products personalised by laser engraving may not be returned or exchanged, except in the event of a defect covered by the statutory warranty or an error attributable to Dagueart.
Warranty
Products sold by Dagueart benefit from the statutory warranty provided under Swiss law.
In the event of a manufacturing defect or lack of conformity, the customer is requested to contact Dagueart as soon as possible and provide a description of the issue together with, where necessary, photographs or videos allowing the issue to be assessed.
After examining the product, Dagueart may, depending on the circumstances:
- repair the product;
- replace the product;
- refund the purchase price.
The warranty does not cover normal wear and tear or damage resulting from improper use, an accident, modification of the product, unsuitable maintenance or any other cause unrelated to a manufacturing defect.
If examination of the product shows that the warranty does not apply, the return shipping costs remain the customer’s responsibility.
8. Liability
Products marketed by Dagueart are designed and sold in accordance with applicable Swiss legislation.
Following delivery, the customer is solely responsible for the use, transportation, storage and maintenance of the products. The customer is also responsible for complying with the laws and regulations in force in their country of residence or destination, particularly those relating to the importation, possession, carrying and use of knives.
Dagueart shall not be held liable for any consequences arising from improper use, negligence, modification of the product or the customer’s failure to comply with applicable legal provisions.
Dagueart shall not be held liable for any delay or inability to perform its obligations where this results from force majeure or any other circumstance beyond its control, including natural disasters, conflicts, strikes, failures of transportation or telecommunications networks, decisions by public authorities or any other unforeseeable event outside its control.
In all circumstances, Dagueart’s liability is limited, to the extent permitted under Swiss law, to direct loss or damage resulting from a breach attributable to Dagueart.
9. Personal data
Personal data collected in connection with an order is processed in accordance with applicable Swiss data-protection legislation.
This information is used exclusively for order processing, invoicing, delivery, after-sales service, warranty administration and the improvement of the services offered by Dagueart.
Certain data may be shared with third-party service providers where this is necessary to fulfil the order, particularly payment service providers or carriers.
For further information regarding the collection and processing of personal data and users’ rights, customers are invited to consult the Privacy Policy available on www.dagueart.com.
10. Intellectual property
All content available on www.dagueart.com, including texts, photographs, videos, 3D renderings, illustrations, logos, graphics, designs, knife models, the configurator and any other material published on the website, is protected by applicable intellectual-property rights.
Unless prior written permission has been granted by Dagueart, any complete or partial reproduction, representation, modification, distribution, exploitation or use of such content is prohibited.
Photographs of personalised products may be used by Dagueart for communication, presentation or promotional purposes, provided that they do not allow a customer or third party to be directly identified.
At any time before such content is published, the customer may request in writing that their personalised product not be used for communication purposes. Dagueart undertakes to comply with such a request.
11. Governing law and jurisdiction
These General Terms and Conditions of Sale are governed by Swiss law.
Subject to any applicable mandatory statutory provisions, any dispute concerning the interpretation, performance or validity of these Terms and Conditions shall fall within the jurisdiction of the courts of the Canton of Neuchâtel, Switzerland.

12. Final provisions
Dagueart’s failure to enforce any provision of these General Terms and Conditions of Sale at any given time shall not be interpreted as a waiver of its right to enforce that provision at a later date.
Should any provision of these Terms and Conditions be declared null, invalid or unenforceable, that provision shall be deemed severed without affecting the validity of the remaining provisions, which shall remain fully applicable.
These Terms and Conditions constitute the entire agreement between Dagueart and the customer regarding sales made through www.dagueart.com and supersede all previous versions.
